The Supreme Court heard oral argument in Tanzin v. Tanvir, concerning whether under the Religious Freedom Restoration Act (RFRA) civil lawsuits can be filed against federal employees in their individual capacity. Muhammad Tanvir and two other Muslim men filed suit against a group of federal law enforcement officers, arguing they were placed on the “No Fly List” because they did not provide information to the FBI about the potential terror activities of members in their religious community because of religious reasons.

The Court on December 10, 2020, ruled 8-0 that under RFRA, individuals may sue government officials in their individual capacities and obtain monetary damages. close
